**General**

These general terms and conditions apply when you, as a consumer, place an order via www.jantana.es and associated sites. An agreement is then established between you and The Middle Path SL, organisation number B19814052, hereinafter referred to as JANTANA.ES.

The terms are applicable only to the Customer who is a consumer and who places orders through the Website.

JANTANA.ES is certified for secure e-commerce and follows its rules and regulations for distance trading.

In order to place an order on the Website, the Customer must be 18 years of age or older. According to Spanish law, JANTANA.ES does not accept credit purchases from persons under 18 years of age. JANTANA.ES reserves the right, in individual cases, to reject or modify an order from the Customer (for example, if the Customer has provided incorrect personal information and/or has payment objections).

JANTANA.ES reserves the right to final sales and any errors in images and wording on the Website, such as errors in product description or technical specification, incorrect prices and price adjustments (such as changes in supplier prices, currency changes) or incorrect information about whether an item is in stock.

JANTANA.ES reserves the right to correct such errors and to change or update information at any time. If an incorrect price has been indicated for an item that the Customer has ordered, JANTANA.ES will notify the Customer of this and await the Customer's approval of the corrected price before proceeding with the order.

All image information on the Website should be considered as illustrations only. Such illustrations cannot guarantee to reflect the number of items the Customer receives or the item's exact appearance, functions or origin.

The website and all its content are the property of JANTANA.ES . The information is protected, among other things, by intellectual property law and market law. This means that trademarks, trade names, product names, images and graphics, design, layout and information about goods, services and other content may not be copied or used without the written approval of JANTANA.ES

**Agreement and Order**

In order to make a purchase through the Website, the Customer must accept the Terms. By accepting the Terms, the Customer agrees to comply with them in full and agrees that he/she has read the information on personal data and has consented to the use of personal data and cookies in accordance with the Privacy Policy of JANTANA.ES .

A purchase agreement is established only when JANTANA.ES has confirmed the Customer's order and the Customer has received an order confirmation from JANTANA.ES by email.

**Prices, rates and payment**

Prices are indicated in EUR and include VAT. Prices do not include payment and shipping fees, which are indicated separately.

We ship all orders from the EU, therefore taxes and fees may apply if you order to a country outside the EU. We always recommend checking with your local customs office for more information.

The Customer may pay in the manner specified on the Website.

JANTANA.ES has the right to charge the Customer already in relation to the order, unless the Customer chooses payment by invoice or another similar payment method and this is approved by JANTANA.ES . In the case of payment by invoice or partial payment, JANTANA.ES or its partners may perform a credit report. JANTANA.ES reserves the right not to always offer all payment methods, or alternatively to change payment methods if what the Customer has chosen for some reason does not work at the time of purchase.

**Delivery and transport**

T JANTANA.ES normally handles your order within 1 day (non-public business days) from the order until the product leaves our warehouse, provided we have the product in stock. When the product has left our warehouse, the responsibility for delivery passes to the shipping companies that deliver your order.

If the packages need to be picked up, the Customer must do so within the time specified in the notification. The Customer always receives a notification showing where and when the packages are to be picked up. The notification can be made by email, regular mail and if the Customer has provided a mobile number, also by SMS.

If the Customer does not pick up the package, JANTANA.ES is entitled to charge the Customer a fee of 50 EUR for the work performed and shipping fees. Please note that uncollected packages do not fall within the scope of the right of withdrawal or free returns.

**Right of withdrawal**

When purchasing products on the Website, a 14-day right of withdrawal always applies in accordance with the Distance Contracts and Contracts Off-Premises Act.

The withdrawal period starts from the day you receive the item.

The product must be returned in an unchanged condition for you, as a customer, to receive a full refund. The product must be sent back well packaged and in its original box.

Products that are sealed for health or hygiene reasons are exempt from the right of withdrawal if the seal is broken by the consumer.
The right of withdrawal can only be applied to complete sets, JANTANA.ES does not approve returns of selected parts of a purchased set (you may return the entire set unopened).

We need the following information:
a) order number (found on your order confirmation, delivery note or invoice)
b) your name and contact details
c) number and names of the products you wish to return

JANTANA.ES must confirm that the return is permitted and that the withdrawal period has not passed before the goods are returned.

The customer is responsible for the return costs and is responsible for the product until it has reached us.

Returns cannot be sent as cash on delivery.

Packages that are not collected at the delivery points do not fall within the scope of the right of withdrawal and JANTANA.ES reserves the right to charge the customer 50 EUR in fees for the work performed and shipping fees.

**Refund**

Once we have received and inspected the returned item, we will refund the full purchase price as soon as possible, excluding shipping costs, but no later than 14 days. If you have paid by card, we will credit the refund amount to your card.

**Applicable law and disputes**

If you have received a defective item, we ask that you contact our customer service immediately. Please describe it in as much detail as possible. If we are unable to resolve the problem, you should of course file a complaint about the product in order to obtain a new one. Complaints should be made in accordance with the instructions you receive from us.

**Products**

All the products we sell in JANTANA.ES is approved in the European Union.

**Personal information**

In connection with your order and/or account registration, you agree that we may store and use your information within our business to complete and provide the service you may expect from us. All processing of personal data is done in accordance with the Data Protection Regulation.

The information you provide about yourself will be used by JANTANA.ES and our partners for payment and delivery. We guarantee that no information about you will be sold or passed on to third parties.

**Force Majeure**

JANTANA.ES is not responsible for delays caused by circumstances beyond our control. JANTANA.ES could not control, such as a general labor dispute, war, fire, lightning, terrorist attack, change in government regulation, technical problems, failures in electrical/telecommunication/data connections or other communications and errors or delays in subcontractor services due to circumstances mentioned herein. These circumstances shall constitute grounds for exemption involving exemption from damages and other penalties. If any of these situations arise, JANTANA.ES will inform the Client at the beginning and at the end of the time of the current situation. If the circumstance has lasted more than two months, both the Client and the Client will be informed of the current situation. JANTANA.ES has the right to cancel the purchase with immediate effect.

**Changes to Terms**

JANTANA.ES reserves the right to make changes to these Terms at any time. All changes to these Terms will be posted on the Website.
